Termination of Residence Permit as a Family Reunification to a Non-Refugee: What You Need to Know

Having your residence permit revoked or denied extension can be a daunting experience. If you are family reunited with a non-refugee, it is crucial to understand the potential causes and consequences.

What happens if your residence permit is revoked?

If your residence permit is revoked, you will be given a deadline to leave Denmark. Failure to comply with this deadline means you are staying illegally in Denmark and risk deportation with a re-entry ban. However, you have the option to appeal the decision, and in that case, you can stay in Denmark while the appeal is being processed.

Reasons for revocation of residence permit

There are several reasons why a residence permit may be revoked or denied extension:

  • Changed circumstances: If the basis for your residence permit no longer exists, e.g., if you no longer live with your spouse/partner.
  • Fraud: If you obtained a residence permit by providing false information.
  • Lack of passport: If you no longer have a valid passport.
  • Schengen Information System (SIS): If you are reported as unwanted in SIS due to serious crime.
  • Other reasons: If you pose a threat to national security, are a war criminal, or have committed serious crimes.

Your personal circumstances

The Danish Immigration Service takes your personal circumstances into account when making a decision. If a revocation would be particularly burdensome for you, they may choose not to revoke your residence permit.
