Losing your residence permit? You might have the right to stay in Denmark!

Have you been working in Denmark for at least 2 years but are about to lose your residence permit?

Many people forget that they might have the right to stay in Denmark, even if their current residence permit expires or is revoked. Labour Market Attachment could be your solution!

Who can apply for a residence permit based on Labour Market Attachment?

This scheme is particularly relevant for you if:

  • You have had a permanent job: You must have worked for at least 2 years with the same employer in Denmark under normal salary and employment conditions.
  • You are a refugee or family member: The scheme applies to refugees, family reunification cases, and accompanying family members of individuals with a residence permit under a number of schemes (see the list on our website).
  • You have assisted Denmark in Afghanistan or fled from Ukraine: If you have a residence permit under the special law for persons who have assisted Danish authorities in Afghanistan or the special law for persons displaced from Ukraine, you can also apply.

IMPORTANT!

  • 7-day deadline: You must apply no later than 7 days after receiving the decision to revoke or refuse to extend your residence permit.
  • Previous schemes: If you have had a residence permit as an accompanying family member of a person with a residence permit under the previous Establishment Card Scheme or Greencard scheme, this scheme unfortunately does not apply to you.

What are the conditions?

  • 2 years of employment: You must have had legal, uninterrupted, and unsupported employment with the same employer for at least 2 years under normal Danish salary and employment conditions.
  • Normal salary and employment: Your salary and employment conditions must be comparable to Danish standards.
  • No abuse: Your previous residence permit must not have been revoked or refused extension due to abuse.
  • No public benefits: You must not have received public benefits in violation of the conditions for your residence permit.
  • Danish bank account: Your salary must be paid into a Danish bank account in your own name.

How long can you stay in Denmark?

You can obtain a residence and work permit for a maximum of 2 years at a time, and after 2 years for a maximum of 3 years at a time.
